Service Agreement:
By engaging Bracho Transportation for hauling services, you agree to the following terms and conditions outlined below. These terms form a binding contract between Bracho Transportation and the customer.
Scope of Services:
Bracho Transportation provides hauling services for various materials and goods as agreed upon with the customer. The specific scope of services, including pickup and delivery locations, quantities, and any additional requirements, shall be clearly defined in the service agreement or corresponding documentation.
Compliance with Laws and Regulations:
Both Bracho Transportation and the customer shall comply with all applicable local, state, and federal laws, regulations, and permits related to transportation, including but not limited to safety, hazardous materials, and environmental regulations.
Responsibilities of Bracho Transportation:
Bracho Transportation is responsible for transporting the agreed-upon materials or goods in a safe, efficient, and professional manner. We will utilize appropriate equipment, ensure proper handling, and adhere to industry best practices and safety standards throughout the transportation process.
Responsibilities of the Customer:
The customer is responsible for accurately providing all necessary information regarding the materials or goods being transported, including proper documentation, permits, and any special handling requirements. The customer shall ensure that the materials or goods are properly packaged, labeled, and ready for transport in compliance with relevant regulations.
Insurance and Liability:
Bracho Transportation maintains appropriate insurance coverage as required by law and industry standards. While we take utmost care to safeguard your materials or goods during transportation, the customer acknowledges that certain risks are inherent in the hauling process. Therefore, the customer is advised to obtain appropriate insurance coverage for their materials or goods.
Pricing and Payment Terms:
The pricing for hauling services shall be agreed upon and outlined in the service agreement or corresponding documentation. Payment terms, including any deposits, milestones, or invoicing schedules, will also be specified. Any additional charges incurred during the transportation process, such as tolls or unforeseen expenses, may be passed on to the customer.
Cancellations and Changes:
Any cancellations or changes to the agreed-upon hauling services must be communicated in writing within a reasonable timeframe. Bracho Transportation reserves the right to apply cancellation or rescheduling fees based on the extent of the changes and any costs incurred.
Force Majeure:
Neither party shall be held liable for any delays, failures, or disruptions in the hauling services resulting from events beyond their reasonable control, including but not limited to acts of nature, labor disputes, accidents, or governmental regulations.
Dispute Resolution:
In the event of any disputes or disagreements arising from the hauling services, both parties agree to seek an amicable resolution through good-faith negotiations. If resolution cannot be achieved, either party may pursue legal remedies available under applicable laws.
By engaging Bracho Transportation for hauling services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. These terms shall govern the contractual relationship between Bracho Transportation and the customer throughout the duration of the hauling services.
